Catholic Medical Association joins lawsuit to overturn transgender mandate

The mandate requires on-demand gender transition for adolescents, regardless of doctor's medical judgment or religious beliefs.

A lawsuit has been filed to challenge a Biden administration mandate requiring doctors to perform gender transition procedures. The lawsuit was filed jointly by the Catholic Medical Association (CMA) and the Alliance Defending Freedom (ADF), who claim the mandate disregards the medical judgments and religious beliefs of doctors. 

According to a press release, The CMA and ADF are representing an OB-GYN doctor who specializes in adolescents. CMA president, Dr. Michael Parker, decried the HHS’s reinterpretation of the Affordable Care Act, which prohibits gender discrimination in medical practice. Dr. Parker said: 

Dr. Parker went on to stress that, “Biological identity must remain the basis for treating patients.”

The new interpretation of the Affordable Care Act requires gender transition interventions, services, procedures, and drugs on demand. These demands must be met, even for children, regardless of a doctor’s conscientious objection, or better medical judgement. 

Senior Counsel of the Alliance Defending Freedom, Ryan Bangert, supported Parker’s statements. Bangert expounded upon the perils of subjecting children to gender transition. 

As the case proceeds, CMA and their co-complainants will seek to demonstrate that Biden’s HHS is overreaching their proper authority. They will further have to prove that this mandate places children’s psychological and physical health at great risk.
